Point.Mf.&t. g4?pt.......----............----.................................- <br />Hearing: Wed. April 4+ 1973; Mashpee Town Hall; 8 PM <br />Petitioner: Fields Point Mfg. Corp. <br />Petition: For a Special Permit to enclose the porch area to the west of the existing <br />New Seabury Country Club. <br />Appeals Board: Peter M. Lawrencer Kevin D. O'Connell. Clara Keliinui <br />Facts and Decision <br />The petitioner requests a Special Permit for the enclosure of the deck area <br />to the West of the existing New Seabury Country Club. The area to which the <br />club is located is zoned R-1 by the 1971 Mashpee Zoning By -Laws. The petition- <br />er asks that the permit be given based on Sec.5.1 which states; <br />"Anv.lawful use of.anv.structure or land.or both.mav be <br />................................. <br />Section 6.2 allows the granting of such a permit providing the Board of Appeals <br />finds that the granting of such permit does not cause a detriment to the area <br />and that the granting of such a permit does not place a demand on community <br />facilities. <br />Section 6.3 Part B, paragraph 13r provides for this requested use by Special <br />permit. <br />Decision' <br />The board finds that the petitioners request for the enlarging and extension <br />of a non -conforming use ( New Seabury Country Club) does not seriously derogate <br />from the intent of the By-Lawp and further the board did not find that the <br />granting of such a permit would be detrimental to the area or place a demand on <br />community facilities. Therefore the Board of Appeals--I�Psues a Special Permit to <br />Fields Point Mfg. Corp, for the enclosure ofhe dec /area to the West of the <br />New Seabury Country Clubs based on the plans attached hereto. <br />Vote: <br />O'Connell- yes <br />Keliinui- yes <br />Lawrence- yes <br />v' FORM 1095 HOBBS & WARREN. INC. <br />
