9. Matters referred to in letter marked "D" as "A" <br />and "B" are the same documents appended hereto marked <br />"B" and "C." <br />10. A copy of said letter marked "D" was received <br />by the Town Clerk on May 23, 1973. <br />11. As of the filing of this appeal, the Petitioner <br />has received no reply from her request set forth in <br />said letter marked "D." <br />12. Notice of this appeal was given to the Clerk <br />of the Town of Mashpee on May 23, 1913, and a copy of <br />the latter notice is annexed hereto and marked "E." <br />WHEREFORE THE PETITIONER PRAYS that the Honorable <br />Court: <br />1. Issue an order of notice to the Respondents; r <br />2, Hear all pertinent evidence and determine the <br />facts; <br />3. Upon the facts so determined, issue a decree - <br />ordering the Planning Board of the Town of Mashpee to <br />expunge from its records the vote denying a r <br />y g approval of <br />Petitioner's definitive plan of Section C, "Santuit <br />Woods" dated March, 1973 and order the Respondent Plan- <br />ing Board to approve said plan; <br />4.
