14. The land in question is not at all suitable for residential <br />house lot development because of its peculiar location. It is bordered <br />on the West by the Otis Trailer Village; on the North by a large gravel <br />pit and a U. S. Government easement zone which prohibits human <br />habitation; on the East and South by Moody Pond, swamps, cranberry <br />bogs, uninhabited woodland, Otis Air Force beach and parking lot and <br />a beach on John's Pond used by Otis Trailer Village. <br />These surrounding conditions as well as the hilly nature of <br />the terrain make the land unsuitable and undesirable for residences. <br />These special conditions are peculiar to this parcel of land and do not <br />generally affect other land in the same district. <br />A strict enforcement of the Zoning By -Law would involve a <br />substantial hardship on the applicant. He has a large financial <br />investment in this land. By placing this land in a residential district <br />and then absolutely prohibiting the use of the land for a Trailer Park <br />or Mobile Home Park, this By -Law is effectively depriving the applicant <br />of the best and possibly only use of his property without any compensation <br />and is unconstitutional and invalid. <br />The granting of the requested variance would result in no <br />injury or detriment to the public good. The use would be compatible <br />to that of the adjoining Otis Trailer Village. All sites will be well <br />maintained and supervised in strict compliance with local and state <br />health regulations. The land for the most part would remain in its <br />natural wooded state in keeping with current environmental concerns, <br />which would be greatly beneficial to the public good. <br />The granting of the requested variance would in no way <br />derogate from the intent and purpose of the Zoning By -Law. As <br />previously stated, the preservation of the land in its natural state would <br />be a far more appropriate use of the land than cutting down the trees <br />and bulldozing the land for use as residential lots. There would be <br />little if any increase in traffic, fire or health hazard for the Town <br />and no undue concentration of population. It would certainly encourage <br />the most appropriate use of this particular parcel. <br />
