TOWN OF MASHPEE <br />BOARD OF APPEALS <br />PETITIONER: Louis Monaco <br />HEARING January 23, 1974 <br />PLACE Mashpee Town Hall <br />FACTS <br />In May of 1973 a building permit #2012 was issued to the <br />Petitioner for the construction of an addition to his home at <br />Lot #13, Rocklanding Road. It was determined later that <br />Lot #13 was 50' - 80' and contained 4,000 square feet. While <br />the addition meets the zoning requirements with regard to front, <br />side, and rear lot lines, the zoning By -Law stipulates under <br />Sec. 7.4 that the maximum lot coverage shall be 20%. Therefore, <br />the building structures on Lot #13 should contain no more than <br />800 square feet. <br />The existing house totals 561.05 square feet, the existing porch <br />totals 233.13 square feet. The proposed addition would add <br />another 440.39 square feet for a total building area of 1,224.57 <br />square feet or nearly 50% more Lot coverage than allowed under <br />Mashpee Zoning Law. <br />On August 20, 1973 a stop work order was issued to the Petitioner <br />(see attachment B) informing him that he had exceeded the building <br />violations was sent to Mr. Philip M. Quatrale, Attorney for the <br />Petitioner (see attachment C)_.. <br />On January 23, 1974 a public hearing was held by the Appeals <br />Board on the petition of Mr. Monaco for a variance from Sec. 7.4 <br />of the Zoning By -Law. <br />DECISION <br />The Popponesset area of Mashpee consists mostly of small summer <br />homes and cottages. A great number of the homes in Popponesset <br />were built on subdivided lots done years before zoning existed <br />in the Town. The majority of Lots in the area average approximately <br />7,000 square feet; however, the Maushop area, and more particularly <br />
