HICKS, as they are the duly <br />constituted members of the Board of Appeals <br />of the Town of Mashpee. <br />PETITION ON APPEAL <br />To the Honorable Judges of the Superior Court: <br />Your petitioner represents as follows: <br />1. The petitioner is a resident of the Commonwealth of Massachusetts, <br />residing at 169 Gifford Street, in the Town of Falmouth. <br />2. That the respondent, Clara L. Kelfinut, resides at Main Street, <br />Mashpee, Massachusetts, and is the Chairman of the Board of Appeals <br />of the Town of Mashpee. <br />That the respondent, Kevin D. O'Connell, resides at Red Brick <br />Road, Maahpee, Massachusetts, and is a member of the Board of <br />Appeals of the Town of Mashpee. <br />That the respondent, Frank E. Hicks, resides at Hamblin Street, <br />Mashpee, Massachusetts, and is a member of the Board of Appeals of <br />the Town of Mashpee. <br />3. That the petitioner to the owner of approximately 20 acres of land <br />located at the northerly end of John's Pond and the southwesterly <br />side of Moody Pond in the Town of Mashpee. <br />II 4. That on February 19, 1974, the petitioner filed with the Board of <br />Appeals for the Town of Mashpee, an application for a variance of the <br />Zoning By -Law of the Town to enable the petitioner to use said land <br />9EPN D.
