Lawrence, Clara Keliinui, Kevin O'Connell <br />Petitioner- R.J.Condon Corp. <br />Petition- For a Special Permit to operate an industrial equipment sale and repair <br />business on Lot 23 Bowdoin Rd. <br />Decision: <br />Lot 23 Bowdoin Rd., Mashpee is shown on a subdivision plan of land in Mashpee <br />by Barnstable Survey Consultants, Inc. 608 Main Street, West Yarmouth for Rob- <br />ert Jr. and Grace C. Mcnutt, scale 1" equals 100' dated July 1968. Said plan <br />was approved by the Mashpee Planning Board on 8/14/68, and the Town Clerk cer- <br />tified that no appeal had been received as of September 4, 1968. <br />In that this plan received approval by the Mashpee Planning Board on August 14, <br />1968 whereby this industrial zone was created wherein said Lot 23 is located, <br />the Zoning By -Laws of the Town of Mashpee for the year 1967 apply. Said 1967 <br />Zoning By -Laws under Chapter III Paragraph F Article II 1(a) permits "Any <br />use permitted in a business district" and under l(c) permits "Any manufac- <br />turing or industrial use." <br />The 1967 Zoning By -Law was amended on I -larch 49 1968 and Chapter _III <br />Article II Business District was changed by inserting after sub -paragraph <br />(a) the following: <br />(b) Additional uses permitted: retail stores, banks, professional <br />offices, service outlets, automobile garages and salesrooms, <br />theatres and restaurants. <br />There were no further changes to the Mashpee Zoning By -Laws until 1971 <br />when the current By -Law was approved. <br />Considering the Petition of R.J. Condon Corp. under the 1967 Zoning <br />By -Laws which would apply in that the plan was approved on August 14, 1968 <br />the petition was apparently unnecessary in that the intended use is a <br />permitted use and no Special Permit is necessary. Therefore, the building <br />inspector of the Town of Mashpee should issue a permit for the construction <br />of a building in accordance with the building code of the Town of Mashpee <br />for the use intended by the Petitioner: To wit: the sales and service <br />of industrial type equipment. <br />Vote - Unanimous <br />FORM 1095 HOBBS @ WARRBN.
