THE COMMONWEALTH OF MASSACHUSETTS <br />TOWN OF <br />MASHPEE <br />DOA RD OF APPEAES, <br />June 14 ................ 19- 2 <br />Decision of the Board of Appeals on the.dppeal, and petition of. <br />John Umina <br />On May 15 a Public Hearing was held at 8:pm in the Mashpee Town Hall on the <br />petition of John Umina for a Special Permit to construct 121 Condominium units <br />on 24.24 acres of land described in Book #1591, page 192 and Book #1483, page 796 <br />at the Barnstable County Registry of Deeds. <br />The Board of Appeals finds that the petitioner has met or exceeded all of -the <br />requirements set forth in Section 9 of the Zoning By -Laws of the Town of'Mashpee <br />dated August 4, 1971, and herewith issues a Special Permit with the following <br />conditions: <br />1. The 121 Units shall be constructed in three phases. Each phase will be a <br />minimum of one year in duration. Phase I and Phase II shall consist of 40 units <br />each, Phase III, for'l-one units. No more than 40 units shall be constructed <br />within a one year period commencing with the issuance of the first building <br />permits, with the exception of Phase III which shall have forty-one units. <br />2. All recreational facilities as per plan: swimming pool, tennis courts and <br />club house, shall be constructed with the first phase (first year). No additional <br />building permits will be issued unless these facilities are completed during <br />Phase I. <br />3.
