TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> Re : Application of Mary K. and John Irwin for a variance to <br /> set-back requirements and minimum lot size requirements. <br /> FACTS <br /> A petition was duly filed by the Petitioners for a variance <br /> to Section 7.4 , Land Space Requirements of the Zoning By-law <br /> as pertains to set-back requirements and minimum lot size <br /> requirements in C-1 zoned area. <br /> Notice was duly given to abutters and owner of land next <br /> adjoining the) land of abutters. Notice was given by publication <br /> by publishing in the Falmouth Enterprise , a newspaper of general <br /> circulation in the Town of Mashpee on August 5 , 1977 and <br /> August 12 , 1977. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, August 24, 1977 at 7 :30 P .M. at which <br /> time the following members of the Board of Appeals were present : <br /> Clara L. Keliinui , Chairman ; Linda Edson Hendricks , Clerk ; and <br /> Peter C. Muse , Alternate member. <br /> The Petitioners ' property consists of a nonconforming parcel <br /> oflland located approximately 400 feet east of the Mashpee Rotary <br /> Circle on the northerly side of Route 28 , abutting property of <br /> William and Ann Tannyhill (brother and sister) on westerly lot <br /> line. The parcel identified as Lot #1 on plan filed by petitioner <br /> with Board of Appeals has 204. 2 feet frontage , 160 feet depth , totaling <br /> 33 , 631 square feet. Petitioners purchased land on 17 March 1970 <br /> prior to the 40 , 000 square feet requirement for C-1 zoned areas. <br /> 1 <br /> l <br />
