TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> DECISION <br /> Rea Petition of The Mashpee Construction Company, Inc. for a variance <br /> A' petition was filed by The Mashpee Comstruction Company, Inc. for a <br /> Variance 'of Section 6.3 F-4 of the land Use Regulations for permission to <br /> F <br /> erect and operate a gasoline station on property lacated on Route 28, <br /> (7/10 of a mile from the Mashpee Rotary) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General laws, Chapter 40A as amended by Chapter 808-of.the-Acts of 1975• <br /> Notice was given by publication by publishing in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on October 17, <br /> 1978 and October 27, 1978, a copy of which is attachedhereto and made a <br /> part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, November 8, 1978 at 8t00 p.m, at which time the following <br /> members of the Board of Appeals were present and acting. throughouto Robert <br /> J. Houle, Michael Makunas, Peter Langler. <br /> Mr. Johnathan S. Helman, an attorney with Wasserman & Saulter, 31 <br /> Milk Street, Boston, Massachusetts, representing The Mashpee Construction <br /> Company, Inc., explained to the Board the intention of constructing a service <br /> station in the industrial zone of the Town of Mashpee. He (Mr. Helman) stated <br /> that this was made possible under Section 10 of the Massachusetts General laws <br /> 40A. Mr. Helman submitted a plan to the Board dated May 12, 1975, and stated <br /> that the lot lines hed been approved by the Mashpee Planning Board, Chapter <br /> 41 - conforming with the lot line regulation of the By-law. <br /> The .Board found under Section 10 of the Massachusetts General Laws <br /> Chapter 4OAt <br />
