Each of the plaintiffs is the owner of real estate in <br /> the Town of Mashpee (hereinafter culled the *Town") . - <br /> , <br /> 4. The property of each plaintiff is in a Residence-1 <br /> zoning district and is adjacent to premises (hereinafter cillod <br /> the "premises") owned by the defendant, rilliam, L. Byrne (herein- <br /> after called "Byrne") . The premises have frontage on Route 130 in <br /> the Town and for a depth of 400 feet from Route 130 are zoned Com- <br /> mercial C-2. The balance of the premises is in an Industrial zon- <br /> ing district. <br /> 5. On that portion of the premises zoned Industrial, <br /> Byrne, in May of 1978, constructed and erected, or permitted to be <br /> constructed and erected, a building or buildings and hoppers and <br /> machinery being used for the manufacture of concrete. <br /> 6. The plaintiffs are informed and believe and therefore <br /> aver that building permits issued to Gilmore Paving and Contracting, <br /> Inc. and dated March 1, 1976 are purported to authorize the construc- <br /> tion of said building or buildings and the erection of the hoppers <br /> and machinery on the premises. <br /> 7. Access from Route 130 to said building or buildings <br /> and to said hoppers and cement manufacturing machinery is gained <br /> over that portion of the locus as lies within the Commercial C-2 <br /> zoning district. <br /> 8.
