Umina for a variance of <br /> Section 6. 3 F-1 of the Land Use Regulations to <br /> erect and operate a gasoline station. <br /> FACTS <br /> A petition was duly filed by the Petitioner for a vari- <br /> ance to Section 6. 3 , F-1 of the Land Use Regulations to erect <br /> and operate a gasoline station on industrially zoned land. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws , Chapter 40A as amended by <br /> Chapter 808 of the Acts of 1975. Notice was given by publi- <br /> cation by publishing in the Falmouth Enterprise , a newspaper <br /> of general circulation in the Town of Mashpee on March 31 , <br /> 1978 and April 7, 1978, a copy of which is attached hereto <br /> and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, April 19, 1978 at 7 : 30 p.m. at which <br /> time the following members of the Board of Appeals were <br /> present and acting throughout: Clara L. Keliinui , Chairman; <br /> Michael Makunas , Vice Chairman ; and Robert J. Houle , Clerk. <br /> The petitioner requested that the hearing be recessed <br /> until ' another date. The Board facing the statutory time dead- <br /> line voted unanimously to deny this request. <br /> The Petitioner requested that he be allowed to withdraw <br /> his petition without prejudice.
