TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> DECISION <br /> Ret Petition of Robert Smith for a Special Permit <br /> A petition was filed by Robert Smith of Mashpee, Massachusetts <br /> requesting a Special Permit under Section 6;.3, E-1 and E-5 of the land Use <br /> Regulations for permission to use the property located on Route 28 and Great <br /> Neck Road, at the Mashpee Rotary, Mashpee, Massachusetts, for an Art Studio, <br /> and for retail sale of merchandise. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975. <br /> Notice was given by publication by publishing.in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on August 21, 1979, <br /> and August 31, 1979, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, September 5, 1979 at 8830 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughouti Michael <br /> Makunas, Chairman, Peter L. langler, Raymond G. Sweeney. <br /> Mr, Robert Smithrindicated to the Board that his intension was to <br /> operate a business selling finished decorative items. Basically remaining open <br /> through mid-October, and reopening in the Spring. <br /> Upon motion duly made and seconded the Board voted unanimously to <br /> grant the request for a Special Permit as requested. <br />• The Board found that the use of the premises would not be detrimental <br /> to the Town or area by reason of excessive traffic noise, or demand on <br /> community facilities. The Board also established that granting the Permit <br /> would be in the best interest of the community, and would be in harmony with <br /> the general purpose and intent of the ordance or by-law, <br />
