TOWN OF MASHPEB <br /> BOARD OF APPEALS <br /> DECISION <br /> Ret Petition of William and Jeanne Foley for a Variance <br /> A Petition was filed by William and Jeanne Foley of Mashpee, <br /> Massachusetts, requesting a Variance tinder Section 7.4 of the land Space <br /> Requirements, for permission to vary the side line and rear yard depth <br /> requirements on property located on Degrasse Road, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General laws, Chapter 40A as amended by Chapter 808 of the Acte of 1975. <br /> Notice was given by publication by publishing in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Nashpoe on February 19, 1980, <br /> and February 29, 1980, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Nall <br /> on Wednesday. March 5, 1980 at 8t30 p.m, at which time the following members <br /> of the Board of Appeals were present and acting throughoutt Michael Makunas, <br /> Chairman, Peter L. Langler, Raymond G. Sweeney. <br /> The Board found that a hardship existed in that the building was <br /> constructed on the abutters property, and was not discovered until sometime <br /> after the purchase of the house. Thus a hardship unique to the lot was <br /> clearly established. <br />
