TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> DECISION <br /> Ree Petition of Elizabeth and Bruce Fulton for a Variance <br /> A petition was filed by Elizabeth and Bruce Fulton, of Mashpee, <br /> Massachusetts for a Variance under Section 7.4 of the land Space Requirements <br /> for permission to vary the minimum frontage and area requirements, and to <br /> move existing residence off lot 101, and construct a new dwelling on property <br /> located on (lot 100) Summersea Road, New Seabury, Mashpee, Massachusetts. <br /> Notice was duly given. to abutters in accordance with Massachusetts <br /> General Laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975. <br /> Notice was given by publication by publishing in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on December 21, 1979 <br /> and December 28, 1979, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, January 9, 1980, at 8:00 p.m, at which time the following <br /> members of the Board of Appeals were present and acting throughout: Michael <br /> Makunas, Chairman, Robert J. Houle, Peter Muse. <br /> Mr. Fulton explained to the Board that Mrs. Fulton's house was <br /> situated exactly in thesmiddle of two lots, and requested permission to move <br /> the house approximately twenty feet to the left and twenty feet back, and to <br /> build a new house on the other lot. <br /> Upon motion duly made and seconded the Board voted unanimously to <br /> deny the request for a Variance as requested. <br /> The Board solicited an opinion from Town Counsels The zoning By-law <br /> states because the Board of Appeals has no authority in the New Seabury Cluster <br /> Zoning, the Building Inspector has the authority to issue a building permit as <br /> long as the number of units has not exceeded the amount specified in the <br />
