McNutt for a Variance <br /> A Petition was filed by Grace C. McNutt, of Mashpee <br /> Massachusetts, requesting a Variance under Section 6.3, G-6 0£ <br /> the land Use Regulations, for permission to change the use of the <br /> property located on Bowdoin Road (Lot 53), Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws, Chapter 40A. Notice was also given by <br /> publishing in the Falmouth Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on November 18, 1980, and <br /> November 25, 1980, a copy of which is attached hereto and made a <br /> part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, December 3, 1980 at 8100 p.m. , at which <br /> time the following members of the Board of Appeals were present <br /> and acting throughout: Robert J. Houle, Michael Makunas, Peter <br /> Muse. <br /> The Petitioner explained to the Board that the property <br /> had originally been .zoned Industrial, but when the Town rezoned, <br /> the lots were divided, and half the property is zoned Residential. <br /> The Board found that the Petitioner established, to the <br /> satisfaction of the Board, a hardship unique to the particular property. <br /> The Board also established that granting the Variance would <br /> not be detrimental to the Town, and would be in harmony with the general <br /> purpose and intent of the ordance or By-law. <br />
