TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> PAg DECISION <br /> Rei Petition of Bruce Fulton for a Variance Case #V-81-12-026 <br /> A Petition was filed by Bruce Fulton, of Mashpee, <br /> Massachusetts for a Variance under Section 7.4 of the Land <br /> Space Requirements for permission to vary the minimum frontage <br /> set back requirements, on property located on Lot 16 Tide Run, <br /> Little Neck Bay, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws, Chapter 40A. Notice was also given <br /> by publishing in the Falmouth Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee, on November 17, 1981, and on <br /> November 24, 1981, a copy of which is attached hereto and made a <br /> part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, December 2, 1981 at 8x00 p.m. at which <br /> time the following members of the Board of Appeals were present <br /> and acting throughout: Raymond G. Sweeney, Michael Makunas, Peter <br /> Lawrence. _ <br /> The Petitioner made the presentation to the Board explaining <br /> that the foundation of the house was in conformance with the By-law, . <br /> i <br /> but because of the air-space requirement, the bay'window was is <br /> violation of the frontage set back requirement, being only 36.9 feet <br /> from the road. <br /> Upon motion duly made and seconded the Board voted ' <br /> unanimously to grant the request for a variance as requested. <br />
