Michael Hayward - Casey#V-81-4-010 . , <br /> e_ r - + <br /> A petition was filed by C. Michael Hayward, of Harvard, <br /> Massachusetts, for a variance under Section 7.4 of the land Space <br /> Requirements for permission to vary the minimum set back •requirements <br /> on property located on Lots #16 and #17 Daniel Island Way, Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General laws, Chapter 40A. Notice was also given by <br /> publishing in the Falmouth Enterprise, a newspaper of general <br /> circulation in the Town of Mashpee on March 17, 1981, and March 24, <br /> 1981, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, April 1, 1981, at 8130 p.m, at which time <br /> the following members of the Board of Appeals were present and <br /> acting throughzut1 Robert J. Houle, Michael Makunas, Peter Lawrence. <br /> Mr. Hayward explained to the Board that a surveyor had <br /> been hired to survey the property and site the house. Because of <br /> an error of the surveyor, the foundation had been poured, and caused <br /> the house to be in violation of the zoning. Because of the requirements <br /> of the septic, the Board of Health had issued a "stop work order", <br /> which has since been resolved. <br />
