TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> DECISION <br /> Re: Petition of Maryann and Edward Pilat for a Variance <br /> A Petition was filed by Maryann and Edward Pilat of Wellesley, <br /> Massachusetts requesting a Variance under Section 9.4 of the Land Space <br /> Requirements, for permission to vary the minimum lot frontage requirements, <br /> on property located on Monahansett Road, Popponesset, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General laws, Chapter 40A as amended by Chapter 808 of the Acts of 1975. <br /> Notice was given by publication by publishing in the Falmouth Enterprise, <br /> a newspaper of general circulation in the Town of Mashpee on July 22, 1980 <br /> and July 29, 1980, a copy of which is attached hereto and made a part hereof. <br /> A public hearing was held_ on the petition at the Mashpee Town <br /> Hall on Wednesday, August 6, 1980 at 8:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughouts Robert <br /> J. Houle, Raymond G. Sweeney, Peter Muse. <br /> The Petitioner explained to the Board the intension to construct <br /> a single family dwelling on the property. <br /> A number of neighbors were present, and stated they were in favor <br /> of granting the Variance, but expressed concern for on street parking in <br /> front of the proposed house. <br /> The Board found that the Petitioner established to the satisfaction <br /> of the Board, a hardship unique to the particular property. <br /> The Board also established that granting the Variance would not be <br /> detrimental to the Town, and would -be in harmony with the general purpose and <br /> intent of the ordance or By-law. <br /> - As a condition to the granting of the Variance the Petitioners are <br /> to provide adequate off street parking. <br />
