This is an action in which the petitioner is appealing <br /> under the provisions. of G.L. c. 40A §21 alleging that it was <br /> aggrieved by a decision of the Board of Appeals of Mashpee refus- <br /> ing to grant a building permit. <br /> 2 . The petitioner is the New' Seabury Corporation having a <br /> usual place of business in Mashpee, County of Barnstable, Common- <br /> wealth of Massachusetts . <br /> 3 . The respondents are Kevin D. O' Connell, Randolph G. <br /> Peters and Clara L. Keliinui, as they constitute the zoning board <br /> of appeals of the, Town of Mashpee, hereinafter referred to as <br /> "the Board" . <br /> In addition, the respondents include Ralph Duchin, Milton <br /> Glass , Donald Hecht , Charles H. Papitz , Lew S . Schwartz, and Peter . <br />
