9 . On March 2 , 1964, at the annual town meeting for <br /> Mashpee , the town voted under Article 37 of the warrant to accept <br /> a deed of 20 . 51 acres of land. The article reads as follows : <br /> "Article 37 . To see if the Town will vote to <br /> accept a gift of a parcel of beach land for <br /> public recreation purposes from Fields Point <br /> Manufacturing Corp . , of ,approximately 20. 51 <br /> acres on Nantucket Sound , said Fields Point <br /> Manufacturing Corporation to provide and <br /> fill a parking space for 300 motor vehicles , <br /> all as shown on a 'Plan of Land in Mashpee , <br /> Massachusetts . Scale 1" - 100 ' January 15 , <br /> 1964, George M. Hayes , C . E . , 101 Altamont <br /> 'Avenue, Melrose, Massachusetts , or take any <br /> other action thereon. ' <br /> Action.: Motion made and seconded to accept <br /> Article as read. Voted Unanimously. " <br /> 10. By deed dated July 13 , 1964, the petitioner conveyed to <br /> the Town of Mashpee a parcel of registered land, later registered <br /> with the Barnstable Registry District of the Land Court on November <br /> 19, 1964. <br /> 11. A deed conveying unregistered land from the Fields Point <br /> Manufacturing Corporation to the Town was recorded in the Barnstable <br /> Registry of Deeds on November 17 , 1964. <br /> 12. The registered land conveyed by petitioner to the Town <br /> consisted of parcels contiguous with the unregistered land conveyed <br /> by Fields Point, but none of which was contiguous with each other . <br /> The deed for these parcels contained the following description: <br /> "The premises hereby conveyed are also shown on <br /> a Plan entitled 'Cluster Zonin� Plan of a Portion <br /> of New Seabury, Mashpee, Mass . , dated January 16, <br /> 1964, by George E. Hayes , Civil Engineer, which <br /> was filed with the Mashpee Board of Appeals in <br /> Appeal No. 1964-1, a copy of which, on five sheets , <br /> entitled 'Subdivision Plan of Land in Mashpee , Mass . , ' <br /> ( 'The Plan' ) is to be registered herewith as Land <br /> Court Plan 11408-34 . <br /> -3- <br />
