We have been unable to obtain a satisfactory <br /> extension due to concern on the part of both parties over pending <br /> litigation and the economic infeasibility of utilizing the <br /> structure during a long, protracted litigation period . Therefore , <br /> we regretfully request that you permit us to withdraw without <br /> prejudice our applications for variances pending before your Board. <br /> We believe that our project would have been an improvement and an <br /> asset to the community of Mashpee and we regret that we are not <br /> going to have . the opportunity to complete it , however, the realities <br /> of the situation are very clear .
