McDonald
A
vs: Town of Mashpee
Dear Ms. LaBute:
As you know, I am representing the Town in the defense of the two
companion cases pending in the Land Court in Boston. In 1974 Malcolm
E. McDonald and/or Malcolm E. McDonald, Trustee and/or Otis Trailer
Village made Application for a Variance to use for adjoining site as a
mobile home park. This Variance was denied on May 8,1974 by the Board of
Appeals. Thereafter an appeal was taken by the petitioner to the Superior
Court in Barnstable, which case was thereafter transferred to the Land
Court. I would very much appreciate your effort in examining your records
so as to furnish me with the following:
(1) The specific date that the Town Clerk filed the decision of the
Board of Appeals, denying the Variance.
(2) The specific date the Town Clerk was notified or served with
process in regard to the Petition for Appeal filed in the
Superior Court.
With many thanks for your anticipated cooperation.
Sincerely yours,
Morris Kirsner
MK:ps
REC F 9 V ED
JAN 13 1983
MASKP22 T'-"d 6" C'dittY
