Upon motion duly made and seconded the Board voted unanimously to <br /> grant the Special Permit under the provisions of Section 6. 3. D. 2. <br /> The Board finds that the proposed use constitutes a health service <br /> consisting of therapeutic massage within the scope of subsection D. 2 of <br /> Section 6. 3. <br /> The approval of this use is subject to the following limitations: <br /> 1. The floor plan attached hereto shall be followed by the applicant <br /> in the conduct of the business. <br /> 2. The personnel furnishing massage services shall be licensed by <br /> the Board of Health in accordance with the General Laws as now <br /> existing or as hereafter amended. <br /> 3. The massage facilities shall comply with all the regulations of <br /> all State and Local Health agencies and/or Boards at all times. <br /> 4. The special permit shall not be assignable or transferable to <br /> another person or location without the express approval of the Board <br /> of Appeals. <br /> 5. The premises shall comply with all requirements of the State <br /> Building Code. <br /> 6. In the event the license issued by the Board of Health is revoked, the <br /> Special Permit granted herein shall terminate and any subsequent use <br /> of the premises for massage shall require a re-application to the <br /> Board of Appeals if the same is then permissable under the Zoning By-Law. <br /> 7. Tha hours of operation shall be limited to between 9 a. m. and 9 p. m. on <br /> Monday through Saturday. <br /> The Board also established that granting the Special Permit would not <br /> be detrimental to the Town, and would be in harmony with the general purpose <br /> and intent of the ordanance or By-law. <br />
