A <br /> TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> RE: Petition of David G. & Libby A. Pike for a Variance Case <br /> #V-85-05-020 <br /> A petition was filed by David G. & Libby A. Pike of Reading, <br /> Massachusetts for a Variance for permission to vary the sideline <br /> setback on property located on 2 Starboard Lane, Popponesset Beach, <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachus- <br /> etts General Laws Chapter 40A. Notice was given by publication in <br /> the Falmouth Enterprise, a newspaper of general circulation in the <br /> Town of Mashpee on April 24, 1985 and May 8, 1985, a copy of which <br /> is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, May 8, 1985, at 7 : 30 p.m. at which time the fol- <br /> lowing members of the Board of Appeals were present and acting th- <br /> roughout: Manuel Costa, Michael Makunas and Cheryl Hawver. <br /> Mr. Pike explained that one hardship 'was the size of the lot. <br /> The second was that he was bringing down two elderly women, one of <br /> which had severe osteoarthritis and severe heart disease with con- <br /> gestive heart failure. Her medical condition merits easy access in <br /> and out of the house as well as avoidance of exposure to harsh <br /> weather. In addition to this Mr. Pike has a lifting problem due to <br /> herniated disc which does not allow him to lift any heavy equipment. <br /> Mr. Pike submitted letters from John P. Berkoben, M.D. and Marx- <br /> Bowens, M.D. There were no abutters that objected to this variance. <br />
