Dubin for a Variance Case #V-85-05-028 <br /> A petition was filed by Barbara H. Dubin of New Seabury, Massach- <br /> usetts for a Variance for permission to vary the front yard setback <br /> requirements on property located on Lot 49, Waterline Drive, New <br /> Seabury, (Little Neck Bay) , Mashpee, Massachusetts,. <br /> Notice was duly given to abutters in accordance with Massach- <br /> usetts General Laws Chapter 40A. Notice was given by publication <br /> in the Falmouth Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee on May 8, 1985 and May 15, 1985 a copy of which <br /> is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, May 22, 1985, at 7130 p.m, at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughouti Manuel Costa, Michael Makunas and William Hanrahan. <br /> Mr. Dubin explained that this was a two fold request, that the <br /> setbeck be 30 feet rather than the 40 feet required and they were <br /> looking for 71 square feet on the 20% lot coverage, an additional <br /> 1%. Mr. Dubin said that the hardship was the very irregular shape <br /> of the lot and that it has less depth because it is close to the <br /> wetland. <br /> Mr. Makunas noted some lattis work on the plans and explained <br /> that this too was considered part of the structure and that it <br /> should not project closer to the road than 30 feet. <br />
