TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> RE: Petition of Dr. Edward & Martha Palank for Variance Case- <br /> #V-85-07-038 _ <br /> A petition was filed by Dr. Edward & Martha Paland of Bedford, <br /> N.H. for a Variance for permission to vary the front, rear and side , <br /> setbacks in a C-2 zoning district on property located on Route 130, <br /> near Chopping Block, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise, a newspaper of general circulation in the Town <br /> of Mashpee on June 26, 1985 and July 3, 1985 a copy of which is <br /> attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, July 10, 1985 at 700 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William Hanrahan, Manuel Costa and Michael Makunas. <br /> Mr. George Benway represented this application. Mr. Benway <br /> explained that this had been a legal buildable lot when it was bought <br /> in February of 1976, at that time it only required a 20 foot setback <br /> from front lines on a 10, 000 square foot lot area. Since that time <br /> the C-2 areas have been changed to 20,000 square foot with a 70 foot <br /> setback from raods. This lot is about 12,000 square feet. Mr.. Benway <br /> said that they could not build anything but a very narrow building. <br /> Their request was to ask for a 60 foot setback, the sidelines are no <br /> problem. In addition there would be a 15 foot back line variance, to <br /> allow a 60 by 30 foot building along with parking. Mr. Benway said <br /> that the petitioners also understood that if a variance is granted that <br /> they would have to return to the Board at a future date for the building <br /> design and parking and other restrictions under a special permit. <br />
