of
TOWN OF MASHPEE
b BOARD OF APPEALS
i TOWN HALL, MASHPEE, MASSACHUSETTS 02649
October 31 , 1985 `
rf1B E0-
Building Inspector
Town of Mashpee
P . O . Box 1108
Mashpee , Massachusetts
Dear Mr . Boyd :
)
Please be advised that the Board has reviewed the decision of
Mr. Collins in approving building permits for construction on eight
lots known as Lots 1342 , 1343 , 1344 , 1345 , 1346 , 1347 , 1348 and 1349
on Land Court Plan 11408-60 .
The Board has unanimously voted this day to direct you to take
action to rescind any permits outstanding on these lots for the reason
that the lots do not comply with the requirements of the zoning by -law.
The Board finds that the original four lot sub-division by New -
Seabury was lawful and in conformance with the original special permit
granted in 1964 .
The Board further finds that these four lots were sold by New
Seabury Corporation and thereafter reacquired in 1983 .
The Board finds that the sale by New Seabury Corporation terminated
its right to further develop the lots as the sale constituted an end to
the development plan contemplated and approved by the Special Permit .
After the holder of the permit created the plan of development and sold
the lots pursuant to this plan , any further rights to re-develop or
alter the scheme of development would require additional Board of Appeal
action .
The reacquisition by New Seabury Corporation of the lots did not
confer power to again exercise development rights under the original
special permit .
The Board adopts this letter as its decision in the appeal of Frank
Fantasia , Bernice Minkin and Solomon Minkin.
MAIHM BOARD OF APPS
RECFI E Wi Liam lHanrah n
iLJI L—
i NOV 1 Manuel Costa
Michael Makunas
