Inc . for a Special <br /> Permit Case SP-85-10-61 <br /> A Petition was filed by Paderborn Development Company. , Inc . of <br /> Mai.stons Mills , Massachusetts for a Special Permit to cluster subdivide <br /> in an R-3 zoning district on property located on Old Falmouth Road , <br /> Mashpee , Massachusetts . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A . Notice was given by publication in the <br /> Falmouth Enterprise , a newspaper of general circulation in the Town of <br /> Mashpee on October 9 , 1985 and October 16 , 1985 a copy of which is <br /> _ attached hereto and made a part hereof . <br /> - A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, October 23, 1985, at 7 : 30 p .m. at which time the following <br /> members of the Board of Appeals were present and acting throughout : <br /> William Hanrahan, Manuel Costa and Michael Makunas . <br /> Mr . Martin J. O 'Malley represented this application. He explained <br /> that it was a 99 lot subdivision . Mr . Bessy also explained that the parcel <br /> is 112 acres that are divided into two parcels one of which is called <br /> Childs River West and Childs River East . These are separated''by a parcel <br /> owned by the Town of Mashpee and through this the Childs River runs . Mr . <br /> Bessy stated that roughly 50% of the entire parcel will remain in open <br /> space . In addition he stated that they would give the Town 10' feet <br /> and up to 20 feet of property for future road widening on Old Falmouth <br /> Road . At this time the matter was taken under advisement . <br /> On December 10 , 1985 the Board of Appeals met and discussed this . <br /> matter once again. It was the Board ' s feeling that the special permit <br /> should be granted with the condition that Old Falmouth Road be up-graded <br /> to current engineering standards . <br /> f <br />
