TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> t� DECISION <br /> RE : Petition of Ronald A . Gill for a Variance Case #V-85-11-066 <br /> A Petition was filed by Ronald A. Gill of Easton, Massachusetts <br /> for a Variance for permission to vary the front setback requirements <br /> in an R-3M zoning district on property located on 68 Samoset Road, <br /> Mashpee , Massachusetts . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise , a newspaper of general circulation in the Town <br /> of Mashpee on October 30 , 1985 and November 6 , 1985 a copy of which is <br /> attached hereto and made a part hereof . <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday , November 13 , 1985 , at 7 : 30 p .m. at which time the following <br /> members of the Board of Appeals were present and acting throughout : <br /> William Hanrahan, Manuel Costa and Michael Makunas . <br /> Mr . Gill explained that most of the problem resulted from the re- <br /> engineering of the lot to maintain distances from septic and well there <br /> P , <br /> was an oversight by the engineer . After looking over the plans it was <br /> the Board ' s feeling that there was a hardship due to the engineering <br /> error as well as the shape of this particular lot . <br /> Upon motion duly made and seconded the Board voted unanimously to <br /> grant the Variance of 10 feet . <br /> The Board also established that granting the Variance would 'not be <br /> detrimental to the Town and would be in harmony with the general purpose <br /> and intent of the ordinance or By-Law. <br /> I <br /> I <br />
