J <br /> i <br /> TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> RE : Petition of Gerald S . Ross for a Variance Case #V-85-11 , 065 <br /> A Petition was filed by Gerald S . Ross of Mashpee , Massachusetts <br /> for a Variance for permission to vary the front setback and sideline <br /> setback in an R-3M zoning district on property located at 260 Cranberry <br /> Ave . , Briarwood , Mashpee , Massachusetts . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the <br /> Falmouth Enterprise , a newspaper of general circulation in the Town <br /> of Mashpee on October 30 , 1985 and November 6 , 1985 a copy of which is <br /> attached hereto and made a part hereof . <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday , November 13; 1985 , at 7 : 30 p .m. at which time the following <br /> members of the Board of Appeals were present and acting throughout : <br /> William Hanrahan , Manuel Costa and Michael Makunas . <br /> Mr . Robert Mills represented Mr . Ross in this matter . He explained <br /> ,v <br /> that there was some problems with the case due to the fact that when the <br /> home was built initially it did not comply with the existing By-Laws at <br /> the time . This was not done intentially by Mr . Ross , he had a building <br /> permit to construct the house and deck . According to Mr . Mills there was <br /> a mix up in the engineering . Mr . Mills said that the existing deck is <br /> non conforming . Mr; Mills indicated that the Ross ' s would do whatever <br /> was necessary to correct the problem with the existing deck in order to <br /> allow for the other,:variances requested . At this time the Board took this <br /> matter under advisement in order to allow Mr . Mills to have a plan drawn <br /> up showing the corrections in the existing deck . <br /> RECEIVED <br /> OMASHPEE TOWN CLERK <br />
