O . Box 1108 <br /> Mashpee, Massachusetts <br /> Dear Mr . Boyd : <br /> Please be advised that the Board has reviewed the decision of <br /> Mr . Collins in approving building permits for construction on eight <br /> lots known as Lots 1342 , 1343 , 1344 , 1345 , 1346 , 1347 , 1348 and 1349 <br /> on Land Court Plan 11408-60 . <br /> The Board has unanimously voted this day to direct you to take <br /> action to rescind any permits outstanding on these lots for the reason <br /> that the lots do not comply with the requirements of the zoning by-law. <br /> The Board finds that the original four lot sub-division by :New <br /> Seabury was lawful and in conformance with the original special permit <br /> granted in 1964 . <br /> The Board further finds that these four lots were sold by New <br /> Seabury Corporation and thereafter reacquired in 1983 . <br /> The Board finds that the sale by New Seabury Corporation terminated <br /> its right to further develop the lots as the sale constituted an end to <br /> the development plan contemplated and approved by the Special Permit . <br /> After the holder of the permit created the plan of development and sold <br /> the lots pursuant to this plan, any further rights to re-develop or <br /> alter the scheme of development would require additional Board of Appeal <br /> action. <br /> The reacquisition by New Seabury Corporation of the lots did not <br /> confer power to again exercise development rights under the original <br /> special permit . <br /> The Board adopts this letter as its decision in the appeal of Frank <br /> Fantasia, Bernice Minkin and Solomon Minkin . <br /> MAHP BOARD OF.
