[1 <br /> TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> raa CA- <br /> RE : Petition of Joseph M. Neves for a Variance Case #V85-12-069 <br /> A petition was filed by Joseph M. Neves of Hyannis , Massachusetts <br /> for a Variance for permission to vary the frontage requirements in an <br /> R-3 zoning district on property located on Pimlico Pond Road, Mashpee , <br /> Massachusetts . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General ' Laws Chapter 40A . Notice was given by publication in the <br /> Falmouth Enterprise , a newspaper of general circulation in the Town <br /> of Mashpee on November 27 , 1985 and December 4 , 1985 a copy of which <br /> is attached hereto and made a part hereof . <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday , December 11 , 1985 , at 7 : 30 p .m. at which time the following <br /> members of the Board of Appeals were present and acting throughout : <br /> Manuel Costa , Michael Makunas and Cheryl Hawver . <br /> Mr . Kenny represented Mr . Neves in this matter . He explained that <br /> the shape of the lot was unusual and that the elevation of the land <br /> drops 12 feet in certain areas . Mr . Kenny asked for a variance of <br /> 10 . 62 feet . <br /> The Board found the hardship to be the topography of the lot . <br /> Upon motion duly made and seconded the Board voted unanimously to <br /> grant the Variance of 10 . 62 feet on lot number 2 (two) . <br />
