7 <br /> TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> r,9g cA- <br /> - RE : Petition of Mary R . Brown for a Special Permit Case FSP-85-12-073 <br /> A petition was filed by. Mary R . Brown of Mashpee , Massachusetts <br /> for a Special Permit for permission to construct a pier extending 14 ' <br /> into the wide part of Great River , 'on Monomoscoy Road in an R3M zoning <br /> district , Mashpee , Massachusetts . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A . Notice was given by publication in the <br /> Falmouth Enterprise , a newspaper of general circulation in the Town <br /> of Mashpee on November 27 , 1985 and December 4 , 1985 a copy of which <br /> is attached hereto and made a part hereof . <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday , December 11 , 1985 , at 7 : 30 p . m. at which time the following <br /> members of the Board of Appeals were present and acting throughout : <br /> Manuel Costa , Michael Makunas and Cheryl Hawver . <br /> Ms. Brown told the Board that this was land courted land . She <br /> continued that the previous owner took this to the land court and said <br /> that they claim this property and they drew the plan . Land court notified <br /> all of the abutters , held a hearing and agreed that the owner owned to <br /> the high water mark . Ms . Brown is the present owner . Mr . Boyd reported <br /> that this had gone before the Conservation Commission and they had no <br /> objections to the dock . <br /> Mr . Delory voiced his opinion as a concerned citizen , and felt that <br /> the property along the water belonged to another owner (owner ' s unknown) . <br /> He had no objections to the dock itself . <br /> The Board found no problems with the dock and felt that the land <br /> courted plan assured them that Ms . Brown was the owner of the land in <br /> question . <br />
