.L <br /> TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> C , TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> DECISION <br /> rgg cA- <br /> RE : Petition of Barnstable Holding Co . , Inc . for a Variance Case <br /> #V-85-12-071 <br /> A petition was filed by Barnstable Holding Co . , Inc . of Hyannis , <br /> Massachusetts for a Variance for permission to vary the setback require- <br /> ments in an R-3M zoning district on property located on Lot 67 , Pinecrest , <br />_ Mashpee , Massachusetts . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A . Notice was given by publication in the <br /> Falmouth Enterprise , a newspaper of general circulation in the Town of <br /> Mashpee on November 27 , 1985 and December 4 , 1985 a copy of which is <br /> attached hereto and made a part hereof . <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday , December 11 , 1985 at 7 : 30 p . m . at which time the following <br /> members of the Board of Appeals were present and acting throughout : <br /> Manuel Costa , Michael Makunas and Cheryl Hawver . <br /> Mr . Dacey represented Barnstable Holding Co . , Inc . in this matter . <br />` He explained that they went down and dug the hole , the foundation was <br /> staked in the hole by the engineer; between the time it was staked and <br /> tthe foundation was poured, Mr . Dacey felt that kids had gotten on the <br /> lot and moved the stakes . <br />` The Board found the hardship to be self-imposed and motioned to <br /> deny the request for Variance . <br /> Upon motion duly made and seconded the Board voted unanimously to <br /> Ideny the Variance . <br />
