O' Neill for a Variance Case <br /> #V-85-04-015 <br /> A petition was filed by Daniel D. O' Neill of West Hyannis- <br /> port, Massachusetts for a Variance for permission to vary the <br /> road setback requirements on property located on Lakewood Drive <br /> and Jones Road, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Mass- <br /> achusetts General Laws Chapter 40A. Notice was given by public- <br /> ation in the Falmouth Enterprise, a newspaper of general circula- <br /> tion in the Town of Mashpee on April 10, 1985 and April 17, 1985 <br /> a copy of which is attached hereto and made apart hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, April 24, 1985, at 7 : 30 p.m. at which <br /> time the following members of the Board of Appeals were present <br /> and acting throughout: Manuel Costa, Michael Makunas and Will- <br /> iam Hanrahan. <br /> f <br /> Nancy Dempsey represented Mr. O'Neill in this matter. She <br /> explained that the lot was a peculiarly shaped piece of land. It <br /> came out of a subdivision approval in 1969. Mr. O' Neill bought it <br /> in 1977. In trying to meet all the sideline and setbacks required, <br /> Mr. O'Neill came up with the plan that the Board was shown, which <br /> comes up 12 feet short of the sideline for Jones Road. <br /> Mr. Costa was familiar with the area and explained to the Board <br /> how Jones Road ran. It was felt that a part of Jones Road could be <br /> abandoned. The only thing that bothered Mr. Makunas was the right of <br /> way should be 40 feet, the plan was misleading because it said 20 foot <br /> right of way. He felt that 20 feet isn' t even a road. This would <br /> actually make the setback 18 feet instead of 28 feet. The Board also <br /> noted the problem with the terrain on the lot. <br />
