Files for a Variance Case #V-85-05-017 <br /> A petition was filed by Richard A. Files of Hyannis, Massachus- <br /> etts for a Variance for permission to vary the minimum lot frontage <br /> requirements on property located on Melissa Ave. , on Mashpee Pond, <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massach- <br /> usetts General Laws Chapter 40A. Notice was given by publication <br /> in the Falmouth Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee on April 24, 1985 and May 1 , 1985 a copy of which <br /> is attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, May 8, 1985. at 7:30 p.m. at which time the follow- <br /> ing members of the Board of Appeals were present and acting through- <br /> out: Manuel Costa, Michael Makunas and Cheryl Hawver. <br /> Mr. Chris William Clark represented Mr. Files on this matter. <br /> Mr. Clark explained that there is an existing summer cottage on the <br /> lot, the by-law does not allow for two dwellings on one parcel so <br /> they would need to split it in half, Mr. Clark said it would be a <br /> waste to tear down the existing cottage. <br /> The Board felt that this variance should be denied because there <br /> is sufficent capibility to make frontage using the planning board <br /> process to subdivide the lot. In addition the Board could find no <br /> hardship. <br />
