TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> r98 DECISION <br /> RE: Petition of John and Rose Yates for a Variance Case <br /> #V-86-04-023 <br /> A Petition was filed by John & Rose Yates of Mashpee, <br /> Massachusetts under Section 7 of the Land Space Requirements <br /> for permission to vary the Lot size in a R-3M Zoning District <br /> on property located on Lot #38, Claulise Avenue, Mashpee, <br /> Massachusetts. <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given <br /> by publication in the Falmouth Enterprise, a newspaper of <br /> general circulation in the Town of Mashpee on April 9 & 16, <br /> 1986, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, April 23, 1986 at 7:30 p.m. at which <br /> time the following members of the Board of Appeals were pre- <br /> sent and acting throughout : William Hanrahan, Manuel Costa <br /> and Peter Lawrence. <br /> The Board of Appeals finds the intent of the Yates is <br /> not in conflict with the intent of the By-Law. The Board <br /> finds the hardship is not self-imposed but that the hardship <br /> was imposed by an error of the third party and that the lot <br /> was an &Oproved lot.. <br />
