Perry for a Variance Case #V-87-02-017 <br /> A Petition was filed by Albert A. Perry of Mashpee, Massachusetts <br /> i <br /> for a Variance for permission to vary the sideline setback require- <br /> ments in a R-3M Zoning District on property located on 35 Fawn Road, <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachu- <br /> setts General Laws Chapter 40A. Notice was given by publication in <br /> the Falmouth Enterprise, a newspaper of general circulation in the <br /> Town of Mashpee on January 28 & February 4, 1987, a copy of which is <br /> attached hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town <br /> Hall on Wednesday, February 11, 1987 at 7:30 p.m. at which time the <br /> following members of the Board of Appeals were present and acting <br /> throughout: William Hanrahan, Michael Makunas and Thomas Sexton. <br /> The Board was informed the applicant relied upon a false marker <br /> placed towards the street to base the location of the addition upon. <br /> The Board was informed that abutting the dwelling on the westerly <br /> side, where the violation appears, is a reserved area. Thru infor- <br /> mation received the Board established that the hardship was not self- <br /> imposed nor would it derogate from the intent or purpose of the By-Law. <br />
