MA 02649 <br /> DECISION <br /> RE: Petition of Nickolas Homes for a Variance Case #V-87-04-041 <br /> A Petition was filed by Nickolas Homes, Inc. of Mashpee, Massachusetts <br /> for a Variance for permission to vary the front setback requirements in a <br /> R-3M Zoning District on property located on Riverview Avenue (adjacent to <br /> Santuit River) , Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publicaiton in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> .April 8 & 15, 1987, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, April 22, 1987 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William Hanrahan, .Manuel Costa and Michael Makunas. <br /> The Board ascertained the hardship was in the shape of the lot and <br /> that an engineering error was made in the placement of the foundation. <br /> Upon motion duly made and seconded the Board of Appeals voted unani- <br /> mously on April 22, 1987 to grant the front setback Variance of 4.22 feet <br /> as requested.. <br />
