MA 02649 <br /> AMENDED DECISION <br /> RE: Petition of Leon Montgomery for a Variance Case #V-87-01-010 <br /> A Petition was filed by Leon Montgomery of Mashpee, Massachusetts <br /> for a Variance for permission to vary the lot frontage requirements in <br /> a R-3M Zoning District on property located on the corner of Ashumet Avenue <br /> and Highland Street, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> January 14 & 21 , 1987, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, January 28, 1987 at 7:30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: William Hanrahan, <br /> Michael Makunas and Cheryl Hawver. <br /> Through information received the Board established the error in the <br /> placing of the foundation to be an engineering error. Questions were raised <br /> from abutters present as to the consistency of the engineering errors in the <br /> area, however the Board did convey to abutters present that the hardship was <br /> not self-imposed by the petitioner: <br /> The Board reached the following Finding of Facts: <br /> 1 .) The Board established that due to an engineering error the hardship <br /> was not self-imposed. <br />
