Rogers for a Variance Case <br /> #V-87-02-014 <br /> A Petition was filed by Joseph R. & Edna E. Rogers of Mashpee, Mass- <br /> achusetts for a Variance for permission to vary the sideline setback re- <br /> quirements in a R-3M Zoning District on property located on 25 Deerfoot <br /> Circle, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> January 28 & February 4, 1987, a copy of which is attached hereto and made <br /> a part hereof. <br /> A public hearing was held on the petition at the Mahspee Town Hall <br /> on Wednesday, February 11, 1987 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William Hanrahan, Michael Makunas and Thomas Sexton. <br /> The Board was informed that the error in the placing of the founda- <br /> tion was made prior to the purchase of the property by the present owners, <br /> and established the error to be an engineering error. The Board estab- <br /> lished the Variance would not be a detriment to the neighborhood. <br /> The Board reached the following Finding of Facts: <br /> 1.) The Board ascertained the hardshipwas not self-imposed. <br /> 2.) Granting of this Variance was found not to be detrimental <br /> to the neighborhood. <br />
