TOWN OF MASHPEE <br /> BOARD OF APPEALS <br /> 3 TOWN HALL, MASHPEE, MASSACHUSETTS 02649 <br /> 1� DECISION <br /> RE: Petition of Burrill Josephs for a Variance Case #V-87-02-015 <br /> A Petition was filed by Burrill Josephs of Mashpee, Massachusetts <br /> for a Variance for permission to vary the sideline setback requirements <br /> in a R-3M Zoning District on property located on 36 Uncle Henry's Road, <br /> Popponesset, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> January 28 & February 4, 1987, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, February 11, 1987 at 7:30 p.m. at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William Hanrahan, Michael Makunas and Thomas Sexton. <br /> Thru information provided the Board established there were no alter- <br /> native locations in which to construct the addition. The Board estab- <br /> lished the visual impact would be minimal and would not be detrimental <br /> to the neighborhood. <br /> The Board reached the .following Finding of Facts: <br /> 1.) The Board determined the hardship was inthe shape of the lot. <br /> 2.) The Board found the visual impact to be minimal. <br /> 3.) Granting of this Variance was found not to be detrimental to <br /> the neighborhood. <br />
