Felger for a Variance Case #V-87-10-103 <br /> A Petition was filed by Harry P. Felger. M.D. of Mashpee, Massachusetts <br /> for a Variance for permission to vary the dock requirements in a R-3 Zoning <br /> District on property located on lot 18 Tide Run Road, (map 120, parcel 187) , <br /> Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> October 14 & 21 , 1987, a copy of which is attached hereto and made a part <br /> hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, October 28, 1987 at 7:30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: Manuel Costa, <br /> Michael Makunas,& Edward Govoni. <br /> The Board finds that there are circumstances relating to the topography <br /> of the petitioner's land which especially affects that land but does not <br /> generally affect the zoning district in which it is located. Those unique <br /> conditions involve the extensive existence of the marsh on the petitioner's <br /> parcel which is unique to that parcel and which is not identical or does not <br /> generally affect abutting parcels or generally the zoning district in which <br /> the petitioner's land is located.
