BOX 1108 <br /> r98 MASHPEE, MA 02649 <br /> DECISION <br /> RE: Petition of Stephen Ball for a Variance Case #V-87-11-111 <br /> A Petition was filed by Stephen Ball of Mashpee, Massachusetts for a <br /> Variance for permission to construct a dwelling within 25 feet of the A.C.E.C. <br /> district on property located on lots 1 & 2 Redbrook Road, (maps 108 & 109, <br /> parcels 25 & 15) , Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in the Falmouth <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee on <br /> October 26 & November 2, 1987, a copy of which is attached hereto and made <br /> a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, November 10, 1987 and continued to November 18, 1987 at which time <br /> the following members of the Board of Appeals were present and acting through- <br /> out: William Hanrahan, Michael Makunas and Edward Govoni . <br /> Through comments and recommendations received by the Mashpee Conserva- <br /> tion Commission and Building Inspector, the Board ascertained that due to the <br /> shape, size and topography of the lot, there is no alternative location in <br /> which to construct the dwelling. <br /> Upon motion duly made and seconded the Board of Appeals voted unani- <br /> mously on November 18, 1987 to grant the three foot Variance within the <br /> A.C.E.C. district as requested with the stipulation this applicant comply <br /> with all "Orders of Conditions" setforth by the Mashpee Conservation Commission. <br />
