Counsel informed the Board that the covenant filed with the plans at <br /> the Registry of Deeds for this subdivision was a road building covenant only <br /> and does not reference the special permit granted by the Board of Appeals. <br /> The Board ascertained the subdivision complies with all the provisions of <br /> the Mashpee Zoning By-Laws. <br /> Upon motion duly made and seconded the Board of Appeals voted unani- <br /> mously on August 26, 1987 to support the petitioner and overrule the Build- <br /> ing Inspectors conditional grant stating they should have been granted with- <br /> out condition and all further building permits may be issued in subdivision <br /> without conditions unless there is a change in circumstance.
