„ 4 <br /> MEMORANDUM <br /> APPLICATION FOR A SPECIAL PERMIT <br /> SOUND VEST ASSOCIATES, INC. <br /> This appeal is being .taken pursuant to Section 12 of the Town <br /> of Mashpee Zoning By-laws . <br /> A <br /> The purpose is to appeal that portion of the remarks section <br /> of the building permits numbered 540, 541, 542, 543 , 544, 545, <br /> 546 , 547, 1548 'and 549 .'issued ,by the Town of Mashpee'.s .Building - - <br /> Inspector, Douglas Boyd ,`V on ,June 2, 1987 which makes the building <br /> permits "subject to modification of special permit dated August <br /> 16 , 1985 Section 6" . <br /> HISTORY <br /> This parcel is owned by Sound Vest Associates , Inc. They <br /> acquired the property from Lovell Realty Trust. When the current <br /> owners purchased the property, they investigated the title and <br /> found that the property had been subdivided and an appropriate <br /> plan had been recorded with the Barnstable County Land <br /> Registration Office . This plan , which is attached hereto as <br /> Exhibit "A" and incorporated herein by reference , contains a <br /> statement on it signed by the members of the Planning Board that <br /> states : <br /> a . that the plan was approved under the subdivision control <br /> law; and <br /> b , that it was sub.Ject to ,covenant dated January 22, 1986 <br /> which is attached hereto as Exhibit "B” and incorporated <br /> herein by reference. <br /> Based upon that representation, the property was acquired . <br /> The subdivision plan, identified as Exhibit "A" was approved <br /> by the Town Planning Board ,pursuant to a Special Permit granted by <br /> -1- <br />
