Komessar for a Special Permit Case #SP-87-09-090 <br /> A Petition was filed by Alice S. Komessar of Mashpee, Massachusetts for <br /> a Special Permit for permission to construct and maintain a timber pier, tee, <br /> stairway and landings in a R-3 Zoning District on property located on lot 10 <br /> Ockway Bay Road, Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts Gen- <br /> eral Laws Chapter 40A. Notice was given by publication in the Falmouth Enter- <br /> prise, a newspaper of general circulation in the town of Mashpee on August 26 <br /> & September 2, 1987, a copy of which is attached hereto and made a part hereof. <br /> A publc hearing was held on the petition at the Mashpee Town Hall on <br /> Wednesday, September 9, 1987 at 7:30 p.m. at which time the following members <br /> of the Board of Appeals were present and acting throughout: William Hanrahan, <br /> Michael Makunas and Edward Govoni . <br /> Comments were received from both the Mashpee Shellfish and Conservation <br /> Commissions. The Board learned there is a limited shellfish resource in the <br /> immediate area. The Board concluded only a temporary disruption to the marine <br /> environment could occur with the construction of the proposed structure. <br /> Upon motion duly made and seconded the Board of Appeals voted unanimously <br /> on September 9, 1987 to grant the Special Permit as requested with the stip- <br /> ulation that the existance of this structure will not interfere with travel <br /> by water or cause substantial disruption to the marine environment and upon <br /> compliance to all "Order of Conditions" setforth by the Mashpee Conservation <br />
