Baldauf for a Variance Case: V-88-09-075
A Petition was filed by Isabel W. Baldauf of Falmouth,
Massachusetts for a variance under Section 7.4 to vary the side line
setback.on property located at 21 Riverside Road (map 119 - Lot 87)
Mashpee, MA.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the Falmouth
Enterprise, a newspaper of general circulation in the Town of Mashpee, on
September 28 and October 5, 1988, a copy of which is attached hereto and
made a part hereof.
4 A public hearing was held on the petition at the Mashpee Town
Hall on Wednesday, October 12, 1988 at 7:30 P.M. at which time the
following members of the Board of Appeals were present and acting
throughout: William Hanrahan, Michael Makunas and Edward Govoni.
The Board was informed that the applicant proposes to rebuild a
cottage in disrepair and move it from its present location on the lot line
to its own lot, requiring a variance in the side line set-back from 12' to
9' . The Board found this variance request will not derogate from the intent
of the By-Laws and would not be adetriment to the surrounding neighborhood.
Upon motion duly made and seconded, the Board of Appeals voted
unanimously on October 12, 1988 to grant the variance request to permit a
side line set back. of 9' .
