Silva for a Variance Case: V-88-09-079A
F
r, A Petition was filed by George J. Silva of Mashpee, Massachusetts
for a Variance for permission to vary the front set back requirements
and lot coverage requirements on property in an I-1 Zoning District
located at Falmouth Road, Route 28 (Map 81, Lot 28) Mashpee, Massachusetts.
Notice was duly given to abutters in accordance with Massachusetts
General Laws Chapter 40A. Notice was given by publication in the Falmouth
Enterprise, a newspaper of general circulation in the Town of Mashpee on
September 28 and October 5, 1988, a copy of which is attached hereto
and made a part hereof.
A public hearing was held on the petition at the Mashpee Town Hall on
Wednesday, October 12, 1988, at 7:30 p.m. at which time the following
members of the Board of Appeals were present and acting throughout:
William Hanrahan, Michael Makunas and Cheryl Hawver.
Counsel for the Applicant presented plans of a two-story building covering
approximately 11,500 square feet to be used for medical offices. The Board
determined that due to the topography of the lot there would be significant
hardship in designing and developing the building and adequate parking
area without a reduction in the minimum front setback requirement and the
1o coverage requirements.
The Board was informed that the Mashpee Water District had no objections
to the petition _
Upon motion duly made and seconded the Board of Appeals voted unanimously
on October 12, 1988 to grant a frontline variance of 25 feet reducing the
frontline set back requirement from 100 feet to 75 feet and a variance on
lot coverage from 30% to 57% including the building and paved area.
a
