MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> Re: Petition of Bradford Wheatley for a Special Permit Case: SP-88-09-074 <br /> A petition was filed by Bradford Wheatley of Mashpee, Massachusetts <br /> fora Special Permit for permission to construct a dwelling in an R-3 <br /> zoning district on property located on Lot 11 Tide Run Road (Map 125 - <br /> lot 253) Mashpee, Massachusetts. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 4OA. Notice was given by publication in the <br /> ` Falmouth Enterprise, a newspaper of general circulation in the Town of <br /> Mashpee on September 28 and October 5, 1988, a copy of which is attached <br /> hereto and made a part hereof. <br /> A public hearing was held on the petition at the Mashpee Town Hall <br /> on Wednesday, October 12, 1988 at 7:30 p.m, at which time the following <br /> members of the Board of Appeals were present and acting throughout: <br /> William Hanrahan, Michael Makunas and Richard Halpern. <br /> The Board was informed that the applicant plans to build a house <br /> in an. ACEC area. No comments were received from the Conservation <br /> Commission. <br /> The Board found that the lot was a buildable lot before the <br /> effective date of Section 11C of the Zoning By-Laws. Upon motion <br /> duly made and seconded the Board of Appeals motioned unanimously on <br /> October 12 to grant the Special Permit to build within the ACEC zone. <br /> The Boardestablishedthat granting this Special Permit would <br /> be in harmony with the general purpose and intent of the ordinance or <br /> by-law. <br /> i <br /> I : <br />
